Abstract

The article presents reflections on the resurgence of the category 'maroon' in Brazilian legislation - Federal Constitution of 1988, where was granted the right to land ownership to certain black groups, nominated arbitrarily by the state as maroon communities; and discuss about the main controversies and disputes that delayed the start of the applicability of the law. The gradual appropriation of the word 'maroon' and consequently the self-affirmation of the maroon identity contributed to the collectivization and strengthening of political struggle for territory. However, the right to ownership of land as legally bound is far from the reality of these groups. The belief in the myth of racial democracy and the institutional racism are here considered as important causes for this. The reflections presented in the article is based on bibliographic and documentary research and participant observation, which is being conducted with the maroon communities located in the Archipelago of Marajó, Pará State - Brazil.
