SOCIAL AND JUDICIAL NOTES ON “AFFIRMATIVE ACTION PUBLIC POLICIES FOR BLACK PEOPLE IN BRAZIL”

Abstract
This work intends to offer social and judicial elements for analyzing the compatibility between affirmative action and quota policies for blacks put in place by the Brazilian State, and international and national jurisprudence. We first explain and comment on internal legislation as well as on the international instruments for the protection of basic human rights, with an ethnic and racial focus, which have been ratified by the Brazilian State, and then do the same for the doctrine and judgments of some cases which have been considered by the Brazilian courts. We conclude that the policies referred to are compatible with the Brazilian legal system, and that they need to be broadened and improved.
