Abstract
This article aims to address the issue of officialization of right of regularization of the lands of the remnants of maroon communities in Brazil, from the insertion of the ADCT (Transitory Provisions Act) in the 1988 Constitution. We seek to reflect about the black communities against the State, especially in the core of the formation of the Brazilian nation state. For this purpose, we highlighted the titration of remnants of maroon communities, emphasizing the dialectic of this process.
