Main Article Content
Abstract
The 1988 Federal Constitution of Brazil establishes steps for democratization in the National State. However, for the accomplishment of democracy, the space and time will become a reference for the realization of the right to land ownership. Article 68 from the Acts of Constitutional Devices Transients (ADCT) makes it the duty of the State to recognize the territoriality and temporality of the Maroons territories. This constitutional recognition reestablishes in the political agenda of the National State the struggle of African peoples and their descendants since the period of the colonial economy of the XVI-XVII centuries, with the Quilombo of Palmares, strengthened struggle in the twentieth century, by black and social movements in the rural and urban areas. Thus, the study aims to present the public policy for access and right to land in the Brazilian State having as specificity the state of Bahia in the XXI century
